Data Privacy Statement

The protection of your personal data has high importance to us. For this reason we hereby inform you which personal data are being processed when visiting our website as well as about your rights. Please read the following information carefully:

Terms used:

All information as name, address, communication data or email address referring to identified or identifiable persons is treated and processed as personal data.

Processing means any automated or non-automated action referring to personal data as data collection, registration, organization, arranging, saving, adaption, modification, read out, use, transfer, publication, synchronization, restriction, deletion or destruction.

Any identified or identifiable person whose personal data are being processed by responsible process owners, is regarded as “concerned person”.

“User” relates to all categories of data processing about concerned persons and includes our business partners as well as visitors of our website.

For the terms used we refer to definitions art. 4 of General Data Protection Regulation (GDPR), all terms as “User” are considered as gender-neutral.

Scale of processing data

For technical reasons your browser transfers the following data to our webserver when visiting our website:

  • Date and time of inquiry
  • Time zone difference according to Greenwich Mean Time
  • Contents of inquiry (concrete site)
  • Operating system and access status /HTTP-status code
  • Transfered data volume

Purpose of data processing

Data saving in log files required for operation ability of our website,
optimization of our website and security of our information technology systems.

Legal basis for processing

Any data collection made for legitimate interest and according to art.6, paragraph 1 lit. f) GDPR for display your website and to guarantee safety of your data.

Duration of data storage

For safety reasons (e.g. abuse or fraud) any information in log files is saved for max.7 days and deleted afterwards unless being required for subsequent evidence. This kind of data will be saved until clarification of the related issue.

Right of objection and deletion

For technical reasons registration of data for preparation of website and saving in log files is essential. For this reason no right of objection for users.

Contact form and email contact

Scope of data processing

When using the contact form on our website the following data will be transferred:
Title, first name*, second name*, company*, customer no., street *, street no.*, post
code, place , email address*, phone no.*, fax no.* message. All fields marked * are
Mandatory fields.

In addition you can contact us – according to your request – by email to one of our available email addresses. In this case any personal data in the email will be processed too. No transmission to third parties. Your data will only be processed for conversation purpose and working on your inquiry.

Purpose of data processing

In case of contacting us by email you show required and legitimate interest in processing of your personal data for contact establishment. Further personal data (as IP address, date, time) serve to avoid misuse of the contact form and to guarantee security of our information technology systems.

Legal basis for processing

In case of contacting us by contact form or email information given by users are being processed for working on your inquiry according to art.6, paragraph 1, lit.b) GDPR.

Duration of data storage

Your personal data will be deleted as soon as no longer required for data collection. This applies to all personal data sent by contact form or email and when no longer required for any conversation with the user. Conversations are considered finished in case of any completion of issues or exchange of information.

Right of objection and deletion

You can withdraw agreement for processing of your personal data at any time.
In case of email contact with ebalta withdrawal from saving your personal data at any time. Thus any conversation cannot be continued. Upon receipt of your notice of withdrawal to info@ebalta.de. all personal data related to contact with ebalta will be deleted.

Applications

Scope of data processing

All applications can be sent by email. See “job offers” for vacancies. Your personal data sent by email will be processed for your application and might be reviewed by our staff department and the responsible personnel manager.

Purpose of data processing

Personal data are processed for the purpose of personnel decisions, in particular for selection procedure of candidates as well as for administrative application procedure.

In case of employment processing of your personal data for implementation in our

In case of nonemployment your personal data will be deleted considering the period for filing suit as per AGG 3 months after final application procedure unless the candidate agrees with long term saving of personal data according to art. 6, paragraph 1 lit. a) GDPR and art. 7 to be considered for future vacancies.

Right of objection and deletion

Your personal data can be renewed or deleted at any time upon your request. Please email us to: bewerbung@ebalta.de unless being in a current application procedure for a certain position in our company. In this case your related data will be saved until expiration of the legal period for filing suit (above all § 15 AGG):

Cookies

Scope of data processing

The cookies used on our website are small text files being saved on your computer when getting connected with our website. Cookies do not harm your computer or contain any harmful software as viruses. Cookies contain a characteristic passphrase for a distinct identification of your browser when reconnecting with the website. Some elements of our website require identification of the related browser even after changing sites.
No personal identification but host configuration for cookie (cookie ID). No co-registration of your cookie ID with name, IP address or similar data for identification of your cookie.

This website uses both transient and persistent cookies.

Transient cookies, e.g. session cookies are deleted as soon as you close down the browser. Session cookies save the so-called session ID identifying different inquiries of your browser as one session. Reconnecting with our website your computer can be identified. Session cookies are deleted on log-out or closing down the browser.

Persistent cookies will be deleted automatically after a certain period depending on the cookie. Cookies can be deleted in the “security configuration” of your browser at any time.

Webanalysis

Scope of data processing

Our website is analyzed by Website Analytics, a service company of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).
Google is in charge of analyzing use of our website by use of cookies. For more information about cookies see “cookies”.
All information about use of our website collected by Google (e.g. visited sites) is transferred to a Google server in the USA, where being saved, analyzed and the result being sent to ebalta in anonymous form.

On our website use of IP anonymization by Google. Within the areas of the European Community or of member states in the European Economic Area your IP addresses is abbreviated by Google before transfer to the USA. In exceptional cases the complete IP address is transferred to the Google server in the USA and abbreviated there.

Google is certified according to EU-US-Privacy Shield assuring data protection for all data transferred to Google in the USA.

Purpose of data processing

Google uses this information on behalf of ebalta for evaluating use of our website and for reports about activities within our website to better facilitate your online experience and to ease use on our website.

Legal basis of data processing

The above purposes are subject to legalized interest of data processing by Google Analytics. Legal basis art. 6, paragraph 1 lit. GDPR.

Duration of data storage

All sessions and campaigns will be finished after a certain period. In general all
sessions without any activity will be closed after 30 minutes, campaigns after six months. Maximum time limit for campaigns: two years.

Right of objection and deletion

The IP address transferred by your browser will not be consolidated with other Google data. You can prevent saving of your cookies by setting your browser software as noted in “cookies”. In addition you can prevent registration of your personal data by cookies and use of our website by downloading and setting up the available Google browser plug-in: https:// tools.google.com/dlpage/gaoptout?hl=de

If registration of your data by Google Analytics is not requested when visiting our website with different gadgets (particularly mobile devices as smartphones or tablets), set up Opt-Out on all used systems. When clicking here you set up Opt-Out-Cookie: Deactivate Google Analytics.

Google reCAPTCHA

We use “Google reCAPTCHA” (hereinafter referred to as “reCAPTCHA”) on our websites. The provider is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”).

The purpose of reCAPTCHA is to determine whether data entered on our websites (e.g. information entered into a contact form) is being provided by a human user or by an automated program. To determine this, reCAPTCHA analyses the behaviour of the website visitors based on a variety of parameters. This analysis is triggered automatically as soon as the website visitor enters the site. For this analysis, reCAPTCHA evaluates a variety of data (e.g. IP address, time the website visitor spent on the site or cursor movements initiated by the user). The data tracked during such analyses are forwarded to Google.

reCAPTCHA analyses run entirely in the background. Website visitors are not alerted that an analysis is underway.

The data is processed on the basis of Art. 6 Sect. 1 lit. f GDPR. It is in the website operators legitimate interest, to protect the operator’s web content against misuse by automated industrial espionage systems and against SPAM.

Facebook Social Plugins

We use so-called Facebook Social Plugins of Facebook Inc., 1601 S California Ave, Palo Alto, California 94304, USA based on our legitimate interest in the interactive use of our website and optimization of our online service, legal basis art. 6 paragraph. 1 lit. f) GDPR (DSGVO). When visiting our site, at first no personal information is passed on to the provider of the plug-in.

We give you the opportunity to communicate directly with Facebook via button. Only when clicking on the marked field it is activated and Facebook get information about your calling the appropriate Website of our on-line service. By activating the plug-in personal data will be transmitted to Facebook and stored outside the European Union, especially in the USA.

By integrating the plugins, Facebook get information about your access to the corresponding page of our website. Being logged in to Facebook, Facebook may be able to assign your visit to your Facebook account which could be prevented by logging out of Facebook before visiting our website. Since the plug-in provider mainly records data collection via cookies, we recommend to delete all cookies before clicking on the grey box via security settings of your browser. We neither have any influence on the collected data and data processing operations, nor are we aware of the full extent of data collection, the purpose of processing, retention period or do have any information about deletion of the data collected by Facebook.

The plug-in provider stores the data collected about your user’s profiles and uses them for the purpose of advertising, market research and / or tailor-made website design. Such an evaluation is particularly made (also for non-logged-in users) for the presentation of needs-based advertising and to inform other social network users about your activities on our website. In case you would like to assert your right of objection to use of your profiles, you must contact Facebook.

Data Security

For safe data processing we take technical, contractual and organizational measures according to latest technics. Thus we assure compliance of regulations according to data privacy act, processed data are protected against destruction, loss, amendment or unauthorized access. Coded transfer of your data between browser and our servers is part of precautions. In case of internet transmission SSL codification is only activated when key symbol appearing in task menu of browser window address https://…… Data transfer is protected against illegal access of third parties by coded technology (SSL Secure Socket Layer). If this option is not available, make sure certain data will not be transferred on internet.

Transfer of data to third parties or third party vendors

Any transmission to third parties only according to legal regulations. We do not transfer them unless required according to art. 6, paragraph 1, lit.b) GDPR for contractual use or for legitimate interest according to art. 6, paragraph 1, lit. f GDPR.

According to art. 28 GDPR and as part of data protected order processing we engage subcontractors for operations, maintenance and hosting of our information-technology systems. We have taken adequate legal precaution as well as technical and organizational measures for protection of any personal data according to general legal regulations.

External service and contents on our website

Due to legitimate interest for analysis, optimization and economic operation of our online services, external service and contents are linked to our website according to art.6, paragraph 1, lit. f GDPR.

For display of browser contents and due to technical reasons when using this service or in case of advertisements of third parties, data as date, time and particularly your IP address will be transferred between you and third parties.
Any use or processing of your data by third parties is beyond our control and we cannot give any binding information on purpose or volume about processing of your data by third parties.
